Roofing Workmanship Warranty – 15 Years

James Kate Construction LLC warrants the workmanship related to complete roof replacement projects for a period of fifteen (15) years from the date of substantial completion. This workmanship warranty covers defects in installation performed directly by James Kate Construction LLC that result in roof leaks or failure due to improper workmanship under normal conditions. This workmanship warranty applies only to the roofing system installed by James Kate Construction LLC and is transferable to subsequent property owners during the warranty period, provided all warranty maintenance requirements have been satisfied.

Conditions of Roofing Warranty Coverage

To maintain the validity of the 15-year roofing workmanship warranty, the property owner must have a roof tune-up and inspection performed by James Kate Construction LLC every three (3) years at a cost of $195 per service visit.  Failure to complete the required maintenance may void this warranty.

Roof tune-ups include a professional inspection, resealing cracked caulking, sealing exposed nail heads, identifying weak points, and helping extend the life of the roof.
James Kate Construction LLC reserves the right to document the roof condition during each maintenance visit and recommend repairs that fall outside normal warranty coverage.

Warranty Exclusions

This warranty excludes damage caused by hail, winds exceeding 70 mph, fire, animals, pests, debris, other contractors, structural movement, manufacturer defects, ventilation, lack of maintenance, missed tune-ups, mold, rot, interior damage, contents damage, consequential damages, or any work performed by parties other than James Kate Construction LLC.

This warranty shall be automatically void if the property owner fails to pay James Kate Construction LLC in full for all contracted work, including approved change orders and supplements, within the agreed payment terms.

Claim Procedure

Warranty claims must be submitted in writing within a reasonable time after discovery, and the owner must provide access for inspection and proof of required maintenance. Unauthorized repairs performed by others may void this warranty.

Limitation of Liability

James Kate Construction LLC’s liability under this warranty is limited solely to the repair of covered workmanship defects. Under no circumstances shall James Kate Construction LLC be liable for incidental, indirect, special, or consequential damages.

This warranty is provided in lieu of all other expressed or implied warranties except where prohibited by applicable law.

This warranty shall be governed by and interpreted under the laws of the State of Texas.

Non-Roofing Workmanship Warranty – 1 Year

Any trade or service performed by James Kate Construction LLC other than roofing shall carry a one (1) year workmanship warranty from the date of substantial completion. This includes, but is not limited to, gutters, siding, painting, interior repairs, fencing, carpentry, and general construction services. Coverage is limited solely to workmanship defects directly caused by James Kate Construction LLC. The non-roofing workmanship warranty is subject to the same exclusions listed above where applicable.
